Welcome to Heather’s Poop Scoop Service! These Terms of Service ("Terms") govern your use of our website and services. By accessing or using this site, you (“Customer”) agree to be bound by these Terms & Conditions (“Terms”). These Terms govern your use of our services and form a legally binding agreement. If you do not agree, do not use the site or services provided by Heather's Poop Scoop Service.


We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified. Intellectual Property Rights


This website is operated by Heather’s Mobile Pet Salon, doing business as Heather’s Poop Scoop Service (hereafter referred to as ‘Heather’s Poop Scoop Service,’ ‘we,’ ‘us,’ or ‘our’). These Terms apply to all users of the site, including browsers, vendors, customers, and contributors of content.


Services

We provide dog waste removal services at the Customer’s designated property. Service availability is subject to scheduling, weather conditions, and safe access to the service area. We reserve the right to refuse or suspend service if:

  • Conditions are unsafe for our employees

  • Access is blocked or hazardous

  • The Customer fails to comply with these Terms

Customer Responsibilities

To ensure safe and effective service, you (the "Customer") agree to:

  • Secure all pets in a location inaccessible to our employees during visits

  • Provide safe, unobstructed access to the service area

  • Disclose property hazards (e.g., broken fences, aggressive animals, recent chemical treatments)

  • Ensure pet waste is free of non-organic or hazardous contaminants (e.g., sharp objects, chemicals)

  • Notify us of any changes to property, pets, or service needs

Failure to meet these responsibilities may result in service suspension or termination without refund.


Biohazard and Waste Handling

Dog waste is a biohazard and may contain harmful pathogens. We follow industry-standard protocols for handling and disposing of waste. Customers acknowledge:

  • We are not liable for health risks from exposure to pet waste unless caused by gross negligence

  • Waste must be accessible and free from hazardous materials

  • We dispose of waste in accordance with local regulations but are not liable for third-party disposal issues

  • Due to local regulations and disposal restrictions, we may be unable to transport pet waste off-site. In such cases, we will utilize the existing waste management systems available at the Customer’s property.


Assumption of Risk

By using our services, you assume all risks related to:

  • Exposure to pet waste or biohazards

  • Property conditions such as uneven ground or weather hazards

  • Pet behavior during or after our visit, including escapes or injuries

We are not responsible for damage or injury unless caused by gross negligence.


Pet Safety and Liability

Customers are solely responsible for ensuring their pets are securely contained and safely separated from our staff during scheduled service visits. This includes:

  • Keeping pets indoors or confined in a secure, separate area that our employees will not access.

  • Ensuring all fences, gates, latches, and pet containment systems are in proper working condition.

  • Notifying us in advance if any pets will be outdoors, loose, or unsupervised during the time of service.

We are not responsible for pet-related incidents, including but not limited to:

  • Pets escaping through open or unsecured gates, damaged fencing, or while staff are entering or exiting the property.

  • Injuries sustained by pets during or following service due to exposure to tools, equipment, or service-related activities.

  • Illness, poisoning, or death of pets due to exposure to yard treatments, other animals, foreign objects, or hazardous conditions unrelated to our actions.

Assumption of Risk:
By using our services, you accept full responsibility for your pet’s behavior and well-being during and after our visits. You acknowledge that it is your duty to prevent harm or escape by securing your pets in advance.


Hold Harmless Clause:
You agree to hold Heather’s Poop Scoop Service harmless and indemnify us from any and all liability, loss, claims, or expenses related to pet injuries, escapes, or fatalities unless caused directly by our gross negligence or intentional misconduct.


Employee Safety

You are responsible for providing a safe and accessible working environment during each scheduled service visit. This includes, but is not limited to:

  • Keeping pets securely confined or indoors to prevent contact with our employees.

  • Maintaining gates, fences, pathways, and service areas in good condition, free from hazards such as broken boards, exposed nails, sharp debris, or aggressive vegetation.

  • Ensuring the service area is free from toxic substances, open pits, holes, unstable surfaces, or any other potentially dangerous conditions.

  • Promptly notifying us of any known hazards on your property (e.g., chemical treatments, aggressive animals, electric fences).

We reserve the right to refuse or suspend service if our employee’s safety is at risk.


Intellectual Property and Limited License

All content on this website—including but not limited to logos, images, graphics, videos, copy, blog posts, and service descriptions—is the property of Heather’s Poop Scoop Service or its licensors and is protected under copyright, trademark, and other intellectual property laws. You are granted a limited, revocable license to access and use the Site solely for personal, non-commercial purposes. You may download or print one copy of individual pages for your personal reference, provided that all copyright and proprietary notices remain intact.


Except as explicitly authorized in these Terms, you may not reproduce, modify, distribute, display, create derivative works from, or otherwise exploit any content from the Site, in whole or in part, without prior written permission.


Photos taken by our team during service visits may be used for promotional purposes, including on our website, social media, and marketing materials. We will never share identifying customer information. If you prefer that photos of your property, pets, or service visits not be used, you must notify us in writing.


Use of Submissions and Photos

By submitting or posting content (e.g., reviews, comments, photos, videos) through the Site, email, text, or social media, you grant Heather’s Poop Scoop Service a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, display, reproduce, distribute, and create derivative works from such content for any lawful purpose, including promotional or marketing use. This includes but is not limited to photos taken by our team during service visits, which may be used on our website, social media platforms, or print materials, unless you specifically request in writing that such images not be used.


You represent and warrant that you own or otherwise control all rights to the content you submit, and that such submissions do not violate the rights of any third party. Heather’s Poop Scoop Service reserves the right, but not the obligation, to monitor and remove content it deems inappropriate or infringing.


If any material you submit is deemed to fall within the definition of a “work made for hire” under U.S. Copyright Law, the rights shall belong solely to Heather’s Poop Scoop Service. Otherwise, by submitting content, you assign all applicable proprietary rights to Heather’s Poop Scoop Service without further compensation.


You acknowledge that we may, but are not obligated to, display your name or username in connection with any submission used.

Limitation of Liability

To the fullest extent permitted by law, Heather’s Poop Scoop Service shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost wages, emotional distress, loss of data, loss of business, or loss of use, arising out of or in connection with the performance of our services or the use of our website.


We are not responsible for:

  • Injuries, illness, or death of pets unless directly caused by our gross negligence or willful misconduct.

  • Property damage resulting from unsafe, inaccessible, or improperly maintained conditions on the Customer’s property.

  • Exposure to or transmission of bacteria, viruses, or other pathogens found in dog waste.

  • Any damages or disruptions caused by weather, acts of nature, force majeure events, or delays outside our reasonable control.

  • Customer or third-party failure to comply with local ordinances or HOA rules regarding waste disposal.

  • Issues related to third-party disposal services or municipal waste handling, where we are not the final party responsible.

No information or advice obtained by you from us, whether oral or written, shall create any warranty not expressly stated in these Terms.


Maximum Liability: In no event shall our total liability to you exceed the amount actually paid by you for the service at issue. If multiple service visits are involved, liability is limited to the specific visit in which the incident occurred.


Indemnification

You agree to defend, indemnify, and hold harmless Heather’s Poop Scoop Service, its owners, employees, contractors, agents, affiliates, and successors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Property conditions or hazards on your premises, including but not limited to broken gates, hidden obstacles, chemical treatments, or unsafe terrain.

  • Injuries or damages caused by your pets, including but not limited to bites, escapes, or aggressive behavior toward our staff or others during or after our visit.

  • Issues related to improper containment of pets, including unsecured gates or fences, or failure to confine animals during scheduled services.

  • Your failure to disclose relevant information regarding property conditions, pet behavior, or waste contamination.

  • Violations of local ordinances or HOA rules related to pet waste, service access, or waste disposal practices.

  • Your failure to comply with these Terms, including failure to provide a safe working environment or timely notice of changes to the service area.

  • Third-party claims arising from your actions or omissions related to our services, including misuse or unauthorized representation of our brand or services.

This indemnity does not apply to claims arising directly from our gross negligence, willful misconduct, or violation of applicable law.


Termination and Refunds

Termination by Us:
We reserve the right to suspend or terminate services immediately, without prior notice, if:

  • Conditions on your property are deemed unsafe for our employees (e.g., aggressive pets, hazardous terrain, chemical exposure).

  • You violate any part of these Terms.

  • Payment is not received or is declined.

Cancellation by You:
You may cancel recurring services at any time by providing at least 48 hours' advance notice before your next scheduled service. Failure to provide timely notice may result in charges for that visit.


Refund Policy:
Refunds are not issued for completed services. Any refund requests for prepaid services will be considered on a case-by-case basis, at our sole discretion, and may be subject to:

  • A pro-rated refund for any unused services.

  • Deductions for any work already performed.

  • Administrative or cancellation fees, if applicable.

We do not provide refunds for partial, interrupted, or unsatisfactory services unless we fail to perform the agreed service due to our own error or negligence. All refund decisions are final.


Dispute Resolution

Any disputes will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), to be held in Houston, Texas. You waive the right to a jury trial or class action.


The prevailing party may recover reasonable attorney fees and costs.


Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Customers consent to the jurisdiction of Harris County, Texas courts for any disputes not subject to arbitration.


Severability

If any part of these Terms is found unenforceable, the rest remains in full effect. We may modify these Terms at any time. Continued use of our services indicates your agreement to the latest version.


Information You Provide

When you contact us, request a quote, submit a booking request, or fill out any form on our website, you may be asked to provide personal information such as your name, address, phone number, email address, and details about your pets or property. By submitting this information, you agree to the following:

  • Use of Information: We use the information you provide solely for the purpose of delivering our services, responding to your inquiries, managing appointments, and improving our customer experience.

  • Communication: You consent to being contacted via phone, text, or email in relation to your service request or ongoing services, including appointment reminders, updates, or promotions.

  • Accuracy: You are responsible for ensuring the information you provide is accurate and up to date.

  • Privacy and Security: We take reasonable steps to protect your information but cannot guarantee absolute security of data transmitted online. For more details, please refer to our Privacy Policy.

We do not sell, rent, or share your personal information with third parties for marketing purposes without your explicit consent.
